terms of sale and use

The ground rules between you and Olaé: what the service includes, how the trial, payment and cancellation work, and what each side commits to.

Version in effect as of October 24, 2026

Translation

This English version is provided for convenience. The French version is the reference version and prevails if there is any difference.

1. purpose

These terms govern the use of Olaé, an online service that helps you create, schedule and publish social media content, published by Zahira El Talhaoui, a sole proprietorship registered in Quebec (Canada), NEQ 2273778631, 5741 Jean-Talon Street East, Montréal, Quebec H1S 1M3, Canada ("Olaé"). By creating an account or subscribing to a plan, you accept them.

2. account

Sign-up is open to people aged 15 and over; paid plans are reserved for adults or people acting with their parents' consent. You agree to provide accurate information and to keep access to your account confidential. Any action taken from your account is deemed to be taken by you.

3. the service

Olaé offers, among other things: AI generation of captions, hooks and scripts, AI image creation within each plan's quota, a media library for your photos and videos, a content calendar, an AI coach, statistics analysis and, depending on the plan, scheduling and automatic publishing to connected networks. The exact content of each plan is described on the Pricing page at the time of subscription.

Olaé relies on information published by the platforms and does not guarantee any result (followers, views, sales). AI-generated content is a suggestion that you must review before publishing.

4. plans and prices

Olaé offers a free plan (Free) and paid monthly or yearly subscription plans (Creator, Pro, Agency). Prices are shown in euros including tax or, for customers in Canada and the Americas, in Canadian or US dollars before tax. Your country's taxes (VAT, GST/QST, sales taxes…) are calculated and added or included at checkout based on your billing address, and appear on your invoice. The applicable price is the one shown at the time of subscription, in the currency chosen at that time; it does not change during the subscription.

A price change does not apply to the current period; it is announced to you by email at least 30 days before the renewal concerned, and you can cancel before then.

5. free trial

The Creator and Pro plans can be tried free for 7 days, once per person. A reminder is sent to you before the trial ends. If you don't cancel before the end of the trial, the chosen subscription starts and the first payment is charged.

6. payment

Payment is made online through Stripe, at the start of each period (month or year). Olaé never has access to your card details. An invoice is sent with each payment and stays available in your workspace.

If a payment fails, Stripe retries and an email lets you know. If it is not settled within 14 days, the account goes back to the Free plan; your content is kept.

7. term, renewal and cancellation

The subscription renews automatically at the end of each period, for the same length. You can cancel at any time from your workspace, in Billing, with the "Cancel" button. Cancellation takes effect at the end of the period already paid, at no cost; amounts already paid are not refunded, except when you use your right of withdrawal (section 8).

For a yearly subscription, an email reminds you of the renewal date and of your option not to renew, between one and three months before that date.

You can change plans at any time. An upgrade is immediate and prorated; a downgrade takes effect at the next period.

8. right of withdrawal

If you are a consumer, whatever your country, you have 14 days from subscription to withdraw, without giving a reason, by writing to contact@getolae.com or using the template below. The refund is made within 14 days, using the same payment method.

By subscribing, you ask for the service to start immediately. If you withdraw after you've started using it, only the amount for the period already elapsed remains due.

Withdrawal template

To Zahira El Talhaoui (Olaé), 5741 Jean-Talon Street East, Montréal, Quebec H1S 1M3, Canada, contact@getolae.com: I hereby give notice that I withdraw from the contract for the Olaé [plan] subscription taken out on [date]. Name, account email address, date.

The right of withdrawal does not apply to professionals (agencies, businesses) subscribing for the needs of their business.

9. acceptable use

You remain responsible for the content you publish, including content suggested by the AI. In particular, you agree to:

  • respect the law and each social network's terms of use;
  • not publish content that is illegal, hateful, misleading, infringing or that violates someone else's privacy;
  • disclose paid partnerships and edited or AI-generated content where the law or the platform requires it;
  • not use Olaé for spam, buying fake followers or automating artificial engagement;
  • not try to get around usage limits, copy the service or disrupt how it works.

In the event of a serious breach, Olaé may suspend or close the account after a warning, except in an emergency or where required by law.

"Unlimited" use on the Pro and Agency plans is subject to a fair use limit of 3,000 generations per month per account.

10. content ownership

The content you upload or create with Olaé belongs to you. You grant Olaé the right to host it, process it and publish it on the networks you choose, solely to provide you with the service, and for the life of your account.

Olaé remains the owner of the software, the brand, the format templates, the rules base and its entire interface.

11. availability and automatic publishing

Olaé makes its best efforts to keep the service available at all times, without being able to guarantee it (maintenance, a provider outage). Automatic publishing depends on the interfaces provided by each social network, which may change, limit or refuse a post. In that case, Olaé lets you know and offers to publish manually; it cannot be held responsible for a social network's decision.

12. liability

Olaé is bound by an obligation of means. For business customers, its liability is limited to direct damages and to the amount paid over the last 12 months. These limits do not apply to consumers beyond what the law allows, nor in the case of gross or intentional misconduct.

13. personal data

How your data is processed is described in the privacy policy. For Agency accounts, Olaé acts as a processor for the data of the agency's clients.

14. changes

These terms may change. Significant changes are notified to you by email at least 30 days before they take effect; if you don't accept them, you can cancel before that date.

15. governing law and disputes

These terms are governed by the laws applicable in Quebec (Canada). If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. If there's a problem, first write to contact@getolae.com so we can find an amicable solution.

If the disagreement continues, you can contact your country's consumer protection body (in Quebec, the Office de la protection du consommateur, opc.gouv.qc.ca; in the European Union, the European Consumer Centres Network). Failing an agreement, the dispute is brought before the competent court under the legal rules; a consumer can always go to the court where they live. For professionals, the courts of the judicial district of Montréal have jurisdiction.
